for the online shop CHRISTINE BATHELT
1. Scope of application
These Terms and Conditions apply to all orders placed by consumers via the CHRISTINE BATHELT online shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession.
2. Contracting party
The purchase contract is concluded with:
Christine Bathelt
Künstlerin
Trautenauplatz 17/7
1190 Wien
Phone: +43 664 538 333 4
E-mail: hello@christinebathelt.com
3. Conclusion of contract
The presentation of the artworks in the online store does not constitute a legally binding offer, but an invitation to place an order. By clicking on the “Place order” button, you place a binding order for the items in the shopping cart. The purchase contract only comes into effect with our confirmation by e-mail or with the delivery of the goods.
The processing of the order and transmission of all information required in connection with the conclusion of the contract is partially automated by e-mail. You must therefore ensure that the e-mail address you have provided to us is correct, that the receipt of e-mails is technically ensured and, in particular, that it is not prevented by SPAM filters.
4. Prices and shipping costs
All prices quoted are final prices including statutory VAT. In addition to the prices quoted, shipping costs may be incurred, which are shown separately in the product description.
5. Payment
Payment can be made either by:
PayPal
Kreditkarte (via Stripe)
6. Delivery
Delivery will be made to the address you specify. The delivery time is usually 1 – 2 weeks, but may vary depending on availability.
7. Right of withdrawal
You may withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you or a third party named by you, who is not the carrier, acquires physical possession of the goods.
To exercise your right of withdrawal, you must inform us (Christine Bathelt, Trautenauplatz 17/7, 1190 Wien, e-mail: hello@christinebathelt.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail).
If you withdraw from this contract, we will – without undue delay and in any event not later than 14 days after receipt of notification of your withdrawal – reimburse to you all payments already received from you, including the costs of delivery (except for the additional costs incurred for a type of delivery requested by you and different from the least expensive type of standard delivery offered by us). We will make such a refund using the same means of payment that you used for the original transaction, unless you have expressly authorized otherwise; in any event, you will not incur any fees as a result of such a refund. We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earliest.
The return or handover of the goods must be made to:
Christine Bathelt, Trautenauplatz 17/7, 1190 Wien
without undue delay, but in any case no later than 14 days after receipt of the notification of your withdrawal. The deadline is met if you send the goods before the 14-day period has expired. You shall bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
8. Retention of title
The goods remain our property until full payment has been made.
9. Warranty
The statutory warranty rights apply. If you have any questions or problems, please contact our customer service at hello@christinebathelt.com.
10. Limitation of liability
We are only liable in the event of intent, gross negligence, negligent injury to life, limb or health or in the event of a slightly negligent breach of a material contractual obligation, and only in the case of fee-based services or the sale of products. A “material contractual obligation” means an obligation the fulfillment of which is a fundamental requirement for the proper performance of the agreement and on which you can normally and reasonably rely. Our liability for slightly negligent breach of a material contractual obligation is limited to the amount of usual and foreseeable damage for this type of contract.
11. Applicable law
These terms and conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Austria.
The European Commission provides a platform for online dispute resolution (OS), available at: https://ec.europa.eu/consumers/odr/. Please note that we are not obliged to settle disputes with consumers before alternative dispute resolution bodies.
